1. About this policy

Flogga Pty Ltd operates Flogga, an online platform for buying and selling pre-owned technology. This policy explains how Flogga collects, uses, discloses, stores and otherwise handles personal information.

Flogga intends to handle personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply, together with other applicable privacy, spam and data-protection laws.

2. Current scope

At public launch, Flogga’s supported transaction scope is buying and selling. Swap, auction, offer, cart and native mobile-app functionality are not part of the public launch unless expressly enabled. If additional features are enabled, this policy also applies to information collected through them unless a supplemental notice states otherwise.

3. Information Flogga may collect

Depending on how you use Flogga, information may include:

  • name, display name, email address, phone number and account credentials;
  • age or eligibility confirmations and verification status;
  • profile details, photographs and communications;
  • listing descriptions, images, prices, categories and item condition;
  • order, delivery, transaction, refund, dispute and review information;
  • delivery and billing addresses;
  • payout onboarding and payment status information received from payment providers;
  • support requests, complaints and evidence you provide;
  • device, browser, IP address, cookies, logs, approximate location and usage information; and
  • marketing preferences and responses to surveys or promotions.

Flogga does not intend to store full payment-card numbers or bank credentials. Stripe or another authorised payment provider collects and processes those details.

4. How information is collected

Flogga may collect information:

  • directly from you when you register, list, buy, message, review or contact support;
  • automatically when you use the website;
  • from other users involved in a transaction or report;
  • from Sharetribe, Stripe, Mapbox and other service providers;
  • from identity, fraud-prevention, delivery or communications providers where used; and
  • from public sources where lawful and reasonably necessary.

If you provide information about another person, you must be authorised to do so.

5. Why information is used

Flogga may use personal information to:

  • create, secure and administer accounts;
  • operate listings, search, messaging, orders, delivery and reviews;
  • enable payments, seller onboarding, payouts, refunds and disputes;
  • verify users or transaction details;
  • prevent fraud, scams, abuse, prohibited conduct and security incidents;
  • respond to support, privacy, safety and legal enquiries;
  • enforce platform rules and comply with legal obligations;
  • monitor, analyse, maintain and improve Flogga;
  • send service communications; and
  • send marketing communications where permitted, with an option to unsubscribe.

6. Disclosure of information

Flogga may disclose information:

  • to another user where necessary for a listing or transaction, such as a display name, delivery details or transaction messages;
  • to Sharetribe, Stripe, Mapbox, Render and other hosting, analytics, communications, support, security, delivery or professional-service providers;
  • to banks, payment networks and financial institutions involved in a payment;
  • to regulators, courts, law-enforcement bodies or other authorities where required or permitted;
  • to advisers, insurers or prospective transaction parties subject to appropriate safeguards; and
  • with your consent or as otherwise notified at collection.

Flogga does not sell personal information as a data-broker product.

7. Public information

Listings, display names, profile content, reviews and other content intended for the marketplace may be publicly visible and indexed by search engines. Do not publish private contact, payment or identity information in a listing.

8. Payments and identity checks

Stripe processes payment, connected-account, payout and related identity information under Stripe’s own terms and privacy policy. Flogga may receive identifiers, verification status, transaction status, masked payment information and fraud or dispute information, but does not control every aspect of Stripe’s processing.

An SMS or identity-verification message may identify Stripe or another provider as the sender.

9. Cookies and similar technologies

Flogga and its providers may use cookies, local storage and similar technologies for authentication, security, preferences, analytics and platform operation. Browser controls can restrict some cookies, but doing so may prevent parts of Flogga from working.

Any non-essential advertising or tracking technology introduced later should be accompanied by an updated notice and any consent mechanism required by law.

10. Overseas disclosures

Some providers may process or store information outside Australia, including in the United States, European Union or other locations in which they or their subcontractors operate. Countries and providers may change over time.

Where required, Flogga will take reasonable steps to ensure overseas handling is consistent with applicable Australian privacy obligations. Provider privacy notices contain further detail about their locations and safeguards.

11. Security

Flogga uses reasonable technical and organisational measures appropriate to the nature of the information and the platform. No internet service or storage system is completely secure.

Users are responsible for protecting passwords and devices and for promptly reporting suspected unauthorised access. Flogga will assess and respond to suspected eligible data breaches in accordance with applicable law, including notification obligations where required.

12. Retention and deletion

Flogga keeps personal information only for as long as reasonably needed for the purposes described in this policy, including transaction records, fraud prevention, dispute handling, taxation, accounting and legal compliance.

Closing an account does not necessarily delete information immediately. Flogga may retain records where required or permitted by law, while taking reasonable steps to delete or de-identify information no longer needed.

13. Access and correction

You may access or update certain information through account settings. You may also request access to or correction of personal information by emailing support@flogga.com.au.

Flogga may need to verify identity before responding and may refuse or limit a request where permitted by law. If access or correction is refused, Flogga will normally explain why and outline available complaint steps.

14. Privacy complaints

Send a privacy complaint to support@flogga.com.au with enough detail to investigate. Flogga will acknowledge and investigate complaints and will normally aim to respond within 30 days, although complex matters may take longer.

15. Children

Flogga is for people aged 18 or over. Flogga does not knowingly permit children to create accounts. If Flogga learns that a child’s personal information has been collected contrary to this rule, it will take reasonable steps to close the account and delete or de-identify the information where appropriate.

17. Changes to this policy

Flogga may update this policy as the platform, providers or law change. Material changes will be notified through reasonable channels before they take effect where practicable. The effective date at the top identifies the current version.
